    Hello.
    You recently discovered that some of my 100Audio music has been published on another site (s), which violates the contractual agreement between you and us.
    I have signed an exclusive China treaty with you.
    I sent you an opellation that you rejected, I wrote you letters that were rejected by the recipient’s mail server.
    So I decided to write here.
    Firstly, I did NOT upload the tracks that were published on other Chinese sites.
    Secondly, in the settings of the regions in which my music is distributed, China is EXCLUDED.
    I am attaching screenshots confirming my words.
    For example, this track:

    I have NOT uploaded it to Chinese stores and in the “Distributor2” picture (see the same cover) you can see all the platforms that have these tracks, but there are NO Chinese stores in this list. Or I’m wrong?
    Perhaps my digital distributor published by mistake and I know that you are not responsible for the actions of digital distributors and platforms on which the distributor publishes tracks.
    I reported this issue to my distributor and they informed me:
    “These releases are now processing for removal from Kanjian, Tencent, NetEase which should take 7 – 14 days to complete.”
    It has been 9 days, but the tracks have not been deleted yet. I wrote another letter to the digital distributor.
    Given the global situation with coronavirus, removal may take longer.
    BUT! I have an EXCLUSIVE AGREEMENT with you, according to which I delegate the right to dispose of my tracks in China! I am confident that you can influence the quickest removal of these tracks from Chinese stores.
    Instead of accusing me of non-compliance with the contract with you, you should have first reported the problem to me, but you put me before the fact of violation and immediately (without understanding the situation) write to me about a fine of $ 1,932. Is that how you solve problems?
    On the other hand, my attempt to contact Chinese stores ended up with responses in Chinese. It looks like bullying from the shops, I take it as an insult from their side.
    I want to remind you once again that you have an EXCLUSIVE AGREEMENT, according to which I delegate the right to dispose of my tracks in China!
    I have NO intention of swearing with you, but you must enter into my position and help on your part in solving the problem by contacting the stores that you indicated to me in the letter, and on the basis of the agreement with you, they must delete this tracks.

    Don’t misunderstand, we respond to all topics on workdays.
    We remain working towards resolve this problem: if you can take down by yourself or your distributor (Please check the Detailed rules of it in the SYSTEM E-mail), you can get back the Redeemable Amount with a part of your total penalty amount. But it’s difficult for us to get more information about tracks on these Chinese streaming platforms or to demand them a solution of removal, because it was uploaded by the distributor of you. We haven’t a channel or a legitimate reason to contact these platforms legally.

    If it’s difficult to remove all of the tracks involved in violation, please choose “NOT all of the tracks involved in violation are able to be removed” in the application for appeal(The link is attached in the SYSTEM E-mail). There are some alternatives you can choose, we have received your application for appeal before, the reason for rejection is that we can’t figure out your exact mean from the Notes you wrote, it seems ambiguous between the alternative you choose and the Notes you wrote. We advise you first to interact closely with your distributor for the quickest removal of these tracks from Chinese stores, it’s the best way for both of us. But if it works less smoothly, you can also choose to resolve this problem by alternative options, but you should read the Note on alternatives carefully.

    Hi, JaNaeo. Please hold my appeal application. My music was removed in less than 24 hours after my friend mediated between me and the customer service.
    All they asked was my ID card and removal request’s form with my signature. It was very easy with the help of Chinese people.
    But unfortunately, now I found one of the streaming services (KUWO) uploaded my music again after they removed it by my request.
    To deal with this problem, my friend in China is now working on it and waiting for Kuwo customer service’s response (evidence screenshot attached).
    I’m confident that this will be cleared soon. so I hope you understand and thanks for your consideration!

    Here’s what the distributor replied to me:
    “We’ve already sent the takedown request to our Chinese partners – it’s now up to them to process this request on their side.”
    They sent a request for deletion on November 18, and already on November 30, and the tracks have not been deleted yet. ((

    Accessed from my local IP, It shows that all of my music from these sites were already removed.
    Could you please help me check it from these sites there?

    Hello.
    I have filed an appeal to downgrade my account to non-exclusive.
    Here’s what I think about the current situation.
    1. After two weeks after the request to delete my tracks from Chinese stores, they are not deleted and I have no influence on their quick deletion.
    2. A distributor who is negotiating with Chinese stores after these two weeks answered me that the removal now takes up to 28 days or more and the removal speed depends only on the Chinese side.
    3. Next year I plan to regularly upload several tracks a month, but if I do not receive a downgraded to a non-exclusive world account, I will have to never publish my tracks on your site again, because I am not sure if my future new tracks are not will end up in Chinese stores.

    Only your choice – to downgrade my account or apply sanctions against me – will directly affect my choice: to continue downloading several tracks per month in 2021, or never to download tracks again.
    I hope for your understanding.

    Hi StockXL,
    This situation is getting more complicated because those platforms have poor business communication with their partners: routenote, songtradr etc.
    I have the same problem and My distributor also failed to negotiate with those platforms.
    If you want your music to be removed from those platforms, I think it’s a good idea to find chinese people who’s willing to help you mediate between you and those platforms customer services otherwise your music will be stuck in there forever and you will never receive any data from them, which is so unlawful and unacceptable! at least, that is what I’m doing right now and let’s see if my friend can help me out of this problem within a week. Maybe he can lend you a hand too!

    2 days ago I’ve just received message about violation Notice. I send you a letters, but letters go back. So, I have to use this chat. I connected with my distributors for terminate licenses on chinese streamings, and they started a proccess. Screen of letter in attach. So, please, give me more time to solve this problem, in view of Christmas and New Year Holidays.

    Could you please tell, what was the final solution of your problem? Since I also fell into this trap. As far as I see, your account has become non-exclusive. Did they take away the difference in profit between exclusive and non-exclusive account during the period of authorship? And also was the amount of the fine returned to you?

    Dear 100audio,

    Please have a look at the email you wrote to me, what do you mean?. You said my appeal is approved and you will give me the redeemable amount but then telling the opposite.
    This has wasted a lot of time and money to fix this problem in order to stand with you. If you’re going to take it then why don’t you just downgrade my account instead of approving my appeal with zero compensation at all?. I hope you will give your earnest consideration about this matter. Thank you!
