    Hello,
    I’m China-Exclusive and if course I know, that I can’t submit my music to other China music stocks. But things seem to be more complicated.
    Could I upload music on streaming services like Tencent, NetEase or others or is it also restricted?
    What about TikTok?
    Sometimes I’ve heard other international platforms could upload your music to third party Chinese platforms without telling you exactly about it. So what services usually cause problems? I’m sure nobody wants to infract the agreement but sometimes it happens by incident..

    Hi,

    If you sign a China-exclusive musician contract, it means that the music you upload on this account can only be sold through the 100Audio in China. Uploading to other music platforms such as Tencent and NetEase is a violation of the contract.(Tik tok is a Chinese streaming media platform, which means that if you upload exclusive music on this platform, you will have copyright risk)

    In addition, this agreement is limited to music platforms in China. If it is a music platform from other countries, as long as they do not carry out business in China, there is no restriction.

    Ok, but what about Taiwan and Hong Kong?

    And what foes ot mean “carry out business in China”? Is it availablity through internet in China? How could we check it?
    Sometimes I have no idea if the company carry out business in China.
    There are some Asian stocks, like Motion Elements. As far as I know, it is Japanese, but I don’t know what If they have a filial department in China. Could anybody give a list of platforms which are ok and not ok?

    Since there are so many similar music platforms around the world, we can’t give you an exact list. I can only list some of the music platforms in China.
    Tencent (QQ music; kuwo; kugou; etc)
    NetEase music
    apple music

    In addition, according to Chinese laws, platforms in Taiwan and Hong Kong are also restricted
    As for platforms in other countries, you need to ask whether the other websites have business in China before signing a contract with them.

    What is wrong with streaming services? They don’t sell licenses! Actually, I don’t know if Tencent sells, but what about Apple Music? Streaming is not licensing.

    This is not just a matter of licenses. The music platforms listed above, such as Tencent, Apple Music, etc., all have music sales services in China. If your exclusive music is uploaded to these platforms, then commercial activities are involved. If your exclusive music is downloaded on these platforms and used for commercial purposes, this involves a violation. In China, music on streaming media platforms can also be used for sale.
    If you are really worried about these issues, you can apply for another non-exclusive account so that you will not be restricted by the terms of the contract.

    Here is just one point. As long as the websites you mentioned have no business in China, they will not violate China’s exclusive treaty.

    You have to explain more about Apple music?
    Many of us are releasing music on streaming services though Distrokid and such.
    If someone is buying a record from Apple music it’s a license for personal use. A listening use. They are not aloud to use the music an any video or other similar business media. It’s just for personal use.

    I searched for Apple music for business and yes I found it but it’s completely out of our control. I can neither choose to be part of it or not if I choose to release my music on Apple music. Actually I can’t do anything on any streaming platform if I choose to release my music. Spotify is the only platform where you can do playlists, but that’s it. It feels strange that Apple music counts as infract of the agreement?

    The exclusive agreement restricts music platforms in China. If it is a foreign music sales platform, we will not restrict it. Of course, to be on the safe side, it is best to confirm with them whether they have business in China when you sign on other platforms.
