100Audio Author Terms

According to the legal relationship between this website and musicians, this regulation is made to enforce a perfect and fair music sales platform, and guarantee 100Audio musicians legitimate interest, and safeguard 100Audio’s normal management.

I. Music Uploading and Auditing

1.1 The musician promises and guarantees all his/her music uploaded to 100Audio are original, with no infringement against the copyright or other interest of 100Audio or any other third party, with no right disputes, and no violation against any laws, regulations, rules or other obligatory provisions.

1.2 The Exclusive musician promises and guarantees to not upload any audio products onto any other third party platforms once uploaded to 100Audio. Such third party refers to other internet audio sales platform or other digital platform that has competitive relation against 100Audio.

1.3 100Audio is entitled to the act of rejecting audio products with problems listed as, but not limited to, the following:

1.3.1 Products displaying acts of plagiarism, imitation, transportation or embezzlement;

1.3.2 Sold products causing harm to others’ legitimate interests;

1.3.3 Products of low quality with either too much imitation or simple repetitions;

1.3.5 Products violating any laws or regulations.

100Audio will carry out auditing the original works uploaded by producers onto 100Audio and other information in accordance with laws, regulations, rules, concerning policies and 100Audio stipulations. Products qualified for initial auditing will be considered as passed and will be allowed to be displayed, shared and sold on 100Audio.

II. Voluntary Selling Statement of Works

The music issuer registers a 100Audio account (on 100Audio.com) in the name of himself/herself for product being uploaded and sold. Every piece of work under the issuer’s account is uploaded and sold voluntarily by the original musician, with no threat or intervention of affection from any third party.

For every deal made concerning the above-mentioned products, the music issuer will independently bear all legal responsibilities. Should the buyer or 100Audio suffer any loss caused by a deal concerning the above-mentioned products, the issuer can be compensated with 5 times the total loss amount.

III. Product Management

Once the work is uploaded onto 100Audio, 100Audio will have the communication rights, exhibition rights and reproduction rights on the information network with the purpose of sales. In order to join efforts in facilitating the market of original music and forcing the users to establish a habit of using original works, 100Audio will offer discounts campaigns from time to time, and all the uploaded works will be considered voluntarily anticipating. In the case of any objections, please contact us at team@mail.100audio.com and voluntarily quit the campaigns.

In addition, any price alteration or gain sharing caused by transfer charges, state tax policies or website operation adjustments, will be announced on the website for one week, and the alteration will come into effect after the publicity ends. 100Audio promises to protect your legal rights and interests in accordance with relevant laws, regulations, rules and international conventions.

IV. Punishment Mechanism

Should the musician upload someone else’s work claiming it to be his/her own original work, or infringe others’ copyright for selling, the piece of work will be deleted after verification and confirming, and the musician’s account will be retrieved.

Should the musician violate any items comprising this regulation, and make no correction after 100Audio’s exigent notice, the musician’s account will be retrieved, and all gain sharing under his/her name will be frozen.

In the case of the above-mentioned product being already purchased, the musician must return all the income earned by this product to the buyer, bear a penalty compensation five times as much as the original price, and undertake all losses caused to 100Audio and the product buyer. The website is entitled to retrieve the account of this user, and freeze all gain sharing under such user’s name.

Should the uploaded work violate the rights or interests of this website, or infringe other music originator’s copyright, 100Audio will reserve the right to hold the musician accountable for infringement, and the musician shall bear all responsibilities for all outcomes caused by the illegal content of the work he/her uploaded.

Both parties must agree with the agreement, and, within the limits permitted by law, 100Audio is entitled with the final interoperation right of this agreement.
