Hello everybody. I would like to create a separate topic for authors who use the second type of contract (Exclusively for China) and make a list of stocks on which we can additionally download our music besides 100Audio and not violate the terms of the contract (Especially so as not to constantly write support) to consult in this topic with forum moderators and ask questions of interest to us.
As an example:
Sites on which we can upload our music:
1) AudioJungle
2) Pond5
3) MottionArray
4) MotionElementsThe sites on which we CANNOT upload our music:
1) ?06/29/2021 00:40 #2501728Hello.
I would like to clarify: can I upload my tracks from “100audio” to “Exclusive for China” on the MotionElements platform (country of location – Singapore) without breaking the agreements with “100audio”?
Please answer either YES or NO.06/29/2021 10:12 #2501906Hi, Musicians
After signing up as a China-exclusive author, items uploaded on 100Audio cannot be uploaded to other music platforms within the territory of the People’s Republic of China for sale or download. It means that every track you uploaded to 100Audio shall not be uploaded elsewhere in China.
Because there are many music websites around the world that carry out related business, we can not provide a detailed list. So you need to confirm with each other’s website that they don’t have any business in China or relevant information.
If any music websites mentioned above have entered the Chinese market or have relevant records in China, you can’t upload items on this website, otherwise, there will be copyright conflict.
06/29/2021 12:18 #2502106Let’s clarify the situation.
“100Audio” is an exclusive track manager in China after registering as an exclusive author from China – right?
Suppose that the tracks, for some reason, ended up in Chinese stores, then “100 Audio” is obliged to contact the store that received the tracks from another platform from China, because under an agreement with “100Audio” – “100Audio is the exclusive distributor of tracks in China.
So why are you so worried and often warn that you cannot upload tracks to other Chinese platforms if you have the right, on the basis of a contract signed with you, to officially contact the store that accidentally got tracks from another platform registered in China and strictly demand their removal?
It is your responsibility to follow the tracks in China and, if tracks are found from another Chinese platform, show the store your signed exclusivity agreement and have the tracks removed from their store.
Now it looks from your side that you are shifting your responsibility to the musicians who may by mistake upload their tracks to another Chinese platform.06/29/2021 13:51 #2502308Hi, StockXMusic
Legally speaking, the copyright of your music belongs to you personally. If there is infringement on other websites and you are not aware of it, you need to contact this website to remove the music, we have no right to intervene.
There have been cases in the past where musicians have intentionally uploaded music to other sites, which is against the spirit of the agreement and unfair to our site.
We suggest that if the above situation occurs, you can actively get in touch with us, and give us feedback on the relevant information.
Thank you for your understanding!
06/29/2021 14:28 #2502391I already had a situation with my second account, when my distributor published my tracks in Chinese stores by mistake and you discovered it. And what happened? You fined me over $ 2,000.
So it turns out that you have a unilateral agreement aimed at “intimidating” the musicians? Why can’t you apply to these sites in court, show your agreement so that those sites remove the music?
Of course, I also contacted my distributor, who made a mistake on his part and started the process of removing tracks from Chinese stores, but I was immediately warned that this could take more than a month due to the situation with the coronavirus around the world.
And about “you need to contact this website to remove music” … I contacted and you know what – I was offered several options for solving this problem:
1.sign some agreement, which is ONLY (I emphasize) ONLY in Chinese, fill it out and send it by ground mail to China;
2. call me to them to solve the problem.
Excuse me, of course, but these options were like a mockery for a user from another country.Regarding MotionElements, you still did not answer: Singapore is not China – right? It’s just that there is Chinese on their website, but I do not understand its features.
So with exclusive China I can publish on this Singapore site: YES or NO?06/29/2021 15:17 #2502450Hi, StockXMusic
We have found that your account StockXL is now a non-exclusive account, which means that all the music in this account can be uploaded to any other music website, and there will be no infringement. So it is possible for you to upload music to MotionElements.
06/29/2021 15:21 #2502451This account – StockXMusic – is exclusively for China. I’ll repeat the question:
Singapore is not China, right?
So with China exclusive, can I post on this Singapore site: YES or NO?06/29/2021 15:28 #2502452Hi,StockXMusic
Singapore and China are not the same country. As long as this website of Singapore has no business in China, it can be uploaded.
07/07/2021 18:16 #2516225Hi, ISAo
Thank you for your feedback. If you want to change to a non exclusive account when you renew your contract, we will send you an email in the next few days with relevant contents of the non exclusive contract attached. You can apply only after the original contract has expired.
Have a nice day!
